Why Disney Refuses to Sue "Escape From Tomorrow"Submit Comment
About a week ago, we showed you the trailer for "Escape From Tomorrow," a risky film from first-time director Randy Moore, who shot the film entirely in Disney World and Disneyland.

The problem is that Moore never asked Disney's permission. Instead, he wrote a script, got a bunch of actors and shot the movie using the kind of cameras tourists would bring to the parks. The result is surprisingly good, with no shaky camera-work. But the story is so dark that it's actually the opposite of what Disney is about.

The film premiered at the Sundance Film Festival, where Disney representatives were heard saying that "Escape From Tomorrow" will never be released anywhere. But surprisingly, the studio has yet to sue. In fact, the film has already been acquired for distribution and will be released on October 11th.

Today, THR posted an article stating that Disney will never sue. Not that they can't, because they definitely can. "Escape From Tomorrow" not only infringes on countless Disney trademarks, but also makes the company seem terrible by showing one of the theme park princesses as a prostitute.

So why won't Disney simply crush the film? It turns out the studio doesn't want to give "Escape From Tomorrow" any publicity, and taking it to court would do just that. Instead, Disney will just let the film get its very limited release and slowly go away without many people even knowing anything about it.

It's called fair use, and as such it covers parodic depictions. As long as the film doesn't pass off trademarked works as their own and doesn't libel Disney through false statements, there's little Disney can do to get an injunction, even if they wanted to do so.

Oh Disney. In 2018, Mickey goes public domain. That's why many have claimed the company is buying up properties like Pixar and Marvel, to diverse their asset portfolio, since they're not going to get a copyright extension like they did in the 70s and 90s. No briefcases of cash to Congress this time.

People have been so inspired by this film there are talks of secretly shooting a film at the Playboy Mansion and making it a lighthearted kids film.

I'm pretty sure Disney could very easily get a permanent copyright on the character if they wanted two. All it takes is a well-versed lobbyist and a bucket of cash to make public domain disappear.

I am really happy this film is coming out!

However they wouldn't have to file a libel suit to prevent the film from coming out. The filmmakers shot a film on Disney property, there were no location permits, which in turn would make most of their production insurance fraudulent. Disney, just like any local business in any small town could fight for their image to not be used. On top of that the film clearly has disney employes in the shots, who obviously were not given character release forms, so it would be pretty easy for Disney to convince one of their employees to file a separate law suit which would prevent the use of that individuals image being on screen.

Regardless, the film is coming out, and I am really happy that some daring young filmmakers succeeded in a product/piece of art that easily could of had them combating law suits and incurring legal fees for the rest of their lives.
