I don't understand. He made the film? Who funded it? HBO? Or did he get the funding, make the movie and then fail to find a willing distributor? And if the latter, wouldn't Soderbergh know enough, be smart enough to secure distribution up front? If the former, why the hell would he insist on making a five million dollar film everyone is telling him no one wants to see made, or even see in theaters? A personal thing?
