A few weeks ago, we heard about a pub in England, called The Hobbit, that's been around for over twenty years. It has been serving cocktails named after popular "Lord of the Rings" characters, like "Frodo" and "Gandalf."

But recently, owner Stella Roberts, received a letter from the franchise rights-owner, the Saul Zaentz Company, to change many of the pub's features or face legal action for infringing on copyrights and trademarks.

Roberts revealed that she can't redesign the pub and also can't afford the license fee to keep the name. In other words, her only option was to shut the doors to the pub.

The outrage sparked a Facebook page, which now has 58,000 followers, and even got the attention of Stephen Fry, who is playing the Master of Laketown in "The Hobbit" film. The actor recently sent this tweet: "Honestly, sometimes I'm ashamed of the business I'm in. What pointless, self-defeating bullying."

But Fry did a lot more than just post comments on Twitter. He and Ian McKellen paid the Saul Zaentz Company the money necessary for the pub to stay open. "I was very shocked," said Roberts. "They've said as soon as they finish filming they would like to come down and visit the pub."

Dunno, but if there were, the world would be a vastly improved place and people like him would hardly get noticed.

Anyway, read something about this over at Slashdot, many of the comments coming from people with legal backgrounds or at least knowing something about the law, and the general consensus IIRC was that if the pub had used that name for most of it's twenty year history, without encountering a legal challenge (cease and desist) the Saul Zaentz Company wouldn't have much recourse, because the law generally would protect the pub on the basis that it has a long-term investment in it's name, and forcing it to change its name would irrevocable damage the business.

Something like that.

^I know, that's what I'm thinking, and I wonder if the 100 dollars ONLY covers the pub's name and not the merchandise they're selling...the story did say that one of the owners commented "this year it's 100 dollars, next year it could be 20,000...", so I don't know.
