Sylvester Stallone Sued for Stealing "Expendables" StorySubmit Comment
Sylvester Stallone and his "The Expendables" co-writer David Callaham are being sued by a man claiming that the film is "strikingly similar" to a script he wrote an submitted to the US Copyright Office in June of 2006.

The man says that Stallone's film shares the same villain, plot about mercenaries, and an opening sequence as his "The Cordoba Caper." And because the script was shopped around Hollywood from 2006-2009, there is a good chance that Stallone and Callaham took a look at it. "There can be no dispute that Stallone and/or Callaham had access to and copied protectable elements of the screenplay," says the lawsuit.

The man seeks unspecified damages and a court order prohibiting further infringement that would arise in the "Expendables" sequel.

No reason so basically his script would had suck anyways so this guy is a broke person wants to take a advantage of a action movie that is a action fan's dream.

Let's hope Stallone isn't sued and that The Expendables 2 turns out to be better than the first one.

Why do people always take so long to get these lawsuits going?

I can't think of another example off the top of my head but I know I've read about at least three or four people in the past year filing copyright lawsuits against movies or books that are 1-4 years old.

First of all Stallone didn't make a whole off of that movie, and he's repeatedly said that the studio is still claiming hidden costs that they suddenly find that have to be paid for anytime he goes and tried to get any real cash-in-hand for the percentages he was originally contracted out for.

For him the movie was a financial wash, the real value being it's success and the fact that they studios were willing to invest in later sequels.

So even if the writer is right and Stallone screw him...While Stallone got screwed out of MILLIONS. Look up how much this movie made domestically and internationally, and all the investors and studios and distribution film companies are still racking up profits for this movie.

And now this chump thinks he's going to get a sizable piece of the pie that Stallone never even got???

And Stallone whose been the business for quite a while. A man that most definitely has read again and again about the multiple cases where some idiotic schmuck has made some claim that their scripts and ideas were stolen and made into a successful movie. Cases where those same people that so willing screwed the f*ck out of Stallone on the Expendables, gladly spend multiple MILLIONs of dollars to defend these exact type of civil claims.

And why are they so gladly spending all that money defending their side when they could probably settle out of court for several of hundred grand?

For two reasons, one you spend five millions dollars defending yourself, you could probably get away with sodomizing Jerry Lewis on camera in the middle of an MDA telethon...

...and the second reason specifically pertaining to stolen screenplay and script ideas multiple times in the past five years in similar cases the studios has spent multiple millions defending themselves...And once the judge rules against the schmuck writer who sued because his idea/script was stolen...

...He immediately charges the full final cost the studios paid out to defend themselves to that same schmuck.

So schmuck that thought he was going to sue and get millions ends up own millions and millions to the studios. And the amount owed is figured up by the same sort of accountants that played role in screwing Stallone out of his cut of the Expendables.

So whether Sylvester Stallone actually stole this man's script or not is irrelevant the studio will out spend him x 10, and x 10 amount will be charged back to him.

So I'm betting Stallone had a good long laugh over this news story.

1)I'm guessing it takes a while to find a lawyer that will take the case.

2)He may be going through the screen writers union.

3)Also presenting evidence(Expendables original draft) that is substantial to show to the courts.

4)He may have been tracking down where his script was sent over those years.

Ummm... I registered (Writer's Guild of America) an Iron Man 'treatment' in the late 80's. It was circulated to Dreamworks, New Line Cinema (who had the rights to an IM movie at the time), etc. And a few elements of my story WAS in the first Iron Man movie. You don't hear me bitchin' about that. Whether my ideas were copied or were just obvious story elements that would be in the origin Iron Man movie, who's to say?

@lebow - no, a 'treatment' (although mine was longer then the industry would have liked). Mine was a 7-9 page synopsis of the story. No point in writing scripts until a person is commissioned to do so. Then there's the screenplay to write (ugh!).

He should get a kickback, but it never would have happened without Sly. Nobody woulda pulled the cast together like he did. Jet Li? Among many others.
