Warner Bros to Alter Ed Helms' Tattoo for "The Hangover Part 2" DVD

We recently reported that a Missouri tattoo artist files a lawsuit against Warner Bros for using the tattoo he did for Mike Tyson on Ed Helms' face in "The Hangover Part 2." He claimed that he owns the copyright to that design.

The tattoo artist tried to stop the film from appearing in theaters, but the judge allowed for the release to continue as planned. The judge has now set a trial date for February 21st, 2012, but that will likely not happen since the studio has decided to digitally alter Helms' tattoo before the DVD release in December.

The court document states: "If the parties are unable to resolve their dispute, Warner Bros does not intend to make any use of the allegedly infringing tattoo after the film ends its run in theaters because Warner Bros will digitally alter the film to substitute a different tattoo on Ed Helms' face. The home video release is currently scheduled for early December 2011, which would allow Warner Bros sufficient time to make the change if it becomes necessary."

That's quite a task Warner Bros will have to take on, since Helms' has that tattoo for the majority of the movie. And I'm not sure how everything will play out since the whole point of that tattoo is that it resembles Tyson's.

Tort law is really killing this nation. Billions spent eveery year just to handle idiotic cases like this. Copyright law is supposed to protect innovation by compensating the innovator. This sh*tstick didn't innovate anything, he ripped off a tatoo from some indigenous tribe and thought he could make a buck. He also knoew who Tyson was when he inked the tat, which is exactly why he came up with that ad hoc copyright sh*t: he knew someone somewhere would 'infinge' on 'his' design, someone with deep pockets.

Stupid f*cker went fishing and WP took the bait.

I also like how WB is going ahead with the film, but will alter the movie for the home release. lol. That's like closing the barn after the horse has already left.

Besides The Hangover 2 wasn't better than the first one but it was funny in it's own right.

The judge ruled that it was protected here at release by exception of satire, but apparently satire is not defended in all areas where the film will be distributed.
I don't see why the studio can't make an agreement with the artist to pay him a small sum for permission to distribute. Whitmill is going to need the money since the tattoo community is furious at him. His court decision opened a legal door that jeopardizes the way classic tattoo shops operate. The first time the judgement gets applied to someone's streetshop, he's going to wake up in an alley with all his fingers resculpted.

I was totally expecting the digital retouching on the dvd though. That's why I assumed they had to reshoot the tattoo shop scene and lose Neeson's footage.

As someone above already posted, this 'artist' could have done just fine taking credit for Tyson's (and thus Helm's) tat. Yet he made a stink about it. f*ck him! Nice to see WB fix this ass via digitally altering the tat (regardless of cost). Someone backs me into a corner like this 'artist' has tried with WB, and they have never liked the results.
