Judge Ruled "Disturbia" Didn't Rip-Off "Rear Window"

Owners of Cornell Woolrich's original short story that Alfred Hitchcock's classic "Rear Window" was based on filed a copyright lawsuit again Steven Spielberg, DreamWorks and Paramount Pictures for developing Shia LaBeouf's "Disturbia" without getting rights to the story.

But a Manhattan federal judge ruled that "Disturbia" has very little to do with the short story or the film. "The main plots are similar only at a high, unprotectable level of generality," the judge said. "Where 'Disturbia' is rife with sub-plots, the short story has none. The setting and mood of the short story are static and tense, whereas the setting and mood of 'Disturbia' are more dynamic and peppered with humor and teen romance."

"Disturbia" hit theaters back in 2007 and grossed $117 million worldwide on a $20 million budget.

When I first saw it I thought it was supposed to be a remake of "Rear Window" for the teens. I was stunned when I heard that it was not the case.

Good on the judge for this one, yes it had the basic premise of "Rear Window" but it is not a carbon copy of the film...plus isn't every film in Hollywood a copy of another film from yesteryear?

Let's compare (spoilers!):

In Rear Window the main character basically can't leave his apartment because he's confined to a wheelchair.

In Disturbia the main character basically can't leave his house because he's under house arrest and has got an ankle monitor.

In Rear Window the main character starts watching his neighbours using a camera with a big telescopic lens and binoculars and notices that one of the neighbours' wife has disappeared after an argument and the neigbour is acting suspicious, carring a large suitcase and wrapping up a knife and saw.

In Disturbia the main character starts watching his neigbours with binoculars and later uses a videocamera as well, he notices one of his neighbour's dates has disappeared after an argument and the neighbour is acting suspicious and he sees him drag a big plastic bag with blood stains into the garage.

In Rear Window the main character's girlfriend and nurse help him investigate and while she's in the neighbour's apartment she gets caught by him when he comes home. The main character thinks the neighbour is going to kill her so he calls the police but they end up arresting his girlfriend.

In Disturbia the main character's friend and (eventual) girlfriend help him investigate and while the friend is in the neighbour's house he almost gets caught when the neighbour comes home but the main character thinks he was caught and possibly killed or about to be killed so he runs out of his house which alerts the police who question the neighbour but arrest the main character although they don't take him away and he's released after his mum and parole officer talk to the police.

In Rear Window the neighbour goes to the main character's apartment to kill him, they fight and the neighbour pushes the main character out the window (although he survives with injuries) but the police witness it and arrested him.

In Disturbia the neighbour goes to the main character's house to kill him, they fight, the main character escapes to the neighbour's house, they fight some more then the main character ends up stabbing the neighbour in the stomache with shears after the main character's mum stabbed the neighbour in the leg then the main character pushes him into a hole in the basement.

Yep, totally different, lol! (OK, the ending is a bit different but then so is the ending of Christopher Reeve's actual official remake of Rear Window.)
