An attorney for director Roman Polanski (Rosemary's Baby, Chinatown, The Pianist) has told a Los Angeles judge that his client won't appear at a hearing this week to seek dismissal of the 31-year-old sex case against him.

A court document filed Monday argues that Polanski's personal appearance is irrelevant to the question of whether official misconduct violated his constitutional rights.

Polanski, now 75, pleaded guilty in 1977 to unlawful sexual intercourse with a 13-year-old girl. He subsequently fled to France.

The judge has refused to consider dismissal as long as Polanski remains a fugitive. If he returns to the United States from France he would risk arrest.

I don't agree with what he did but he is a holocaust survivor and isn't an American citizen. His wife was murdered by the Mansin family and that girl's mom was a washed up actress who basically pumped her out. The victim has forgiven him and he spent 40 some days in psychiatric evaluation in CA. Watch the doc I mentioned, the whole story will make you think. The guy def. needs therapy.

Hey it was a sh*t situation and I think the guy should have been institutionalized after his wife's death. People do f*cked up sh*t in grief; booze, sex, drugs, fights. First of all, I think all of you "screaming with outrage" people lack logic. After all, you don't want Polanski to walk free in America, right? Well, that hearing was for a dismissal of charges. That meant he could be free as a bird, and no longer banned from the US shores. So you should all be GLAD that he won't show up, instead of screaming bloody murder. @ Blank x2 I thought we were past the anti-French knee-jerk reaction. I guess not. But let me clarify: Polanski is NOT an American fugitive, because he never was an American citizen. He is/was a French citizen. France doesn't extradite its own citizens, but guess what: do does America! If you think that the US should have a right to protect its own people, then you have to grant that right to France as well. @ GrandpasWeiner Firing squad? For statutory rape? Okay... But if you executed every man guilty of sleeping with an underage girl, then you would have killed quite a chunk of US population. What's your ambition - to be "better" than Iran? Crazy people... @ Space_Ghost11 -Polanski cannot visit United States since 1978, and that's no small thing for a movie director; - every time his name gets mentioned, the sex charges are brought up,so I wouldn't say he gets totally away with it. Besides, could you please try to be upset about some more recent case? A one that's less than freaking 32 years old? @ acslaterson I think your sympathy for Polanski is a bit misplaced, especially if we're talking about the present. He is far from crazy or dangerous. He's been married for 20 years to Emmanuelle Seigner, they have 2 great kids, he's still working. And if he is any danger to society, then it's a problem for us, Europeans, not Americans, so I really don't get all this excitement on your part.
